These Terms of Use (the "Terms") are an agreement between you and Pieratt Group LLC ("we," "us," or "our") covering your use of theautomatedlandscaper.com (the "Site") and your purchase and use of The 7-Minute Proposal System and its included tools and bonuses (together, the "Product"). By using the Site or buying the Product you agree to these Terms. If you do not agree, do not use the Site or buy the Product.
1. Who can use the Site and Product
You must be at least 18 years old. The Product is business education for landscape contractors and similar trade professionals. You are responsible for making sure your use of it complies with the laws, licensing rules, and advertising rules that apply to your own business in your own location.
2. What the Product is
The Product is a set of digital documents: a system manual, field tools, and bonuses, delivered as PDF files and two editable Word documents through a private download page. Nothing is shipped. The Product teaches a selling process. It does not include software, and the only third party tool it relies on is a ChatGPT Plus account, which you obtain separately from OpenAI under OpenAI's own terms and pricing.
3. Purchases, billing, and the retailer
- Orders are processed by ClickBank, our retailer. The order form, payment processing, receipts, and refunds are handled on ClickBank's systems under ClickBank's client contract and purchase terms, which also apply to your order.
- The charge appears on your bank or card statement as CLKBANK.
- Prices are stated on the Site at the time of purchase and can change at any time without notice. The launch price applies only while available and is not retroactive.
- This is a one time purchase. There is no subscription and no recurring billing for the Product.
- Download access is available for one year from the date of purchase. The files you download during that time are yours to keep and use as described below. We recommend downloading and saving all of your files soon after purchase.
4. Your license to the Product
When you buy the Product you get a license, not ownership of the content. The license is personal to you and one business you own or work for.
You may
- Download and keep copies of the files for your own use on your own devices.
- Use the system, scripts, and prompts in your own business, on your own jobs, with your own customers, without limit.
- Share the materials internally with employees of your own company who need them to do their jobs.
The two rebrandable documents
The Company Profile Template and the Client Magnet Guide are provided as editable Word documents that you are meant to customize with your own name, logo, photos, and story. For these two documents only, you may also distribute your customized versions to your own prospects and customers as part of running your business, in print or digitally. That is what they are for.
You may not
- Resell, license, rent, or give away the Product or any part of it, including the uncustomized templates.
- Post the files or their contents publicly, upload them to file sharing sites, or include them in other products, courses, memberships, or AI training datasets.
- Share your download access, receipt link, or order number with anyone outside your business.
- Claim authorship of the Product or remove copyright notices.
We can revoke download access for violations of this section. Revocation for violation does not entitle you to a refund outside the guarantee terms.
5. Intellectual property
The Product, the Site, and their contents are owned by Pieratt Group LLC and protected by copyright and other laws. "The Automated Landscaper," "The 7-Minute Proposal System," "The Five-Move Playbook," and the names of the included tools are trade names of Pieratt Group LLC. Third party names on the Site, including ChatGPT, Jobber, ServiceTitan, and LMN, are trademarks of their respective owners, are used only to identify those products, and do not imply any affiliation or endorsement in either direction. Trust marks such as the CSLB license record, BBB accreditation, and Angi awards refer to San Diego Landscape Solutions Inc, the licensed contracting business whose results are described on the Site.
6. Acceptable use of the Site
- Do not attempt to bypass, probe, or overload the purchase verification on the buyer download page.
- Do not scrape, frame, mirror, or republish the Site.
- Do not use the Site to transmit malware or interfere with its operation.
7. Educational content, not professional advice
The Product is business education based on the author's own experience running a licensed landscape contracting business. It is not legal, financial, tax, or accounting advice, and it is not advice about the building codes, contractor licensing rules, or consumer protection laws of your jurisdiction. Rules about bids, contracts, deposits, and advertising vary by state and country. Consult your own professionals where it matters.
8. Results and earnings
Results described on the Site are real results from the author's own established business and are not a promise of what you will earn. Your results depend on you. Read the full Earnings Disclaimer, which is part of these Terms.
9. Refunds
The Product carries a 60 day money back guarantee, described in the Refund Policy, which is part of these Terms. Refunds are processed by ClickBank.
10. Disclaimer of warranties
The Site and the Product are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error free, that files will be free of defects, or that the methods taught will produce any particular outcome in your business.
11. Limitation of liability
To the fullest extent allowed by law, Pieratt Group LLC and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising from the Site or the Product, even if we were advised such damages were possible. Our total liability for all claims combined will not exceed the amount you paid us for the Product. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to defend and hold us harmless from claims and expenses, including reasonable attorney fees, arising from your violation of these Terms or your use of the Product in your business, including documents you customize and distribute under your own name.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Before filing any claim, you agree to contact us at support@theautomatedlandscaper.com and give us 30 days to work it out with you, which usually means a refund. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. Nothing in this section limits any consumer rights you have under the law of your place of residence that cannot be waived by contract.
14. Changes to the Site and these Terms
We may update the Site, the Product, and these Terms. Changes to the Terms apply from the date posted and do not reduce the license or guarantee attached to a purchase you already made. The date at the top shows the current version.
15. General
If part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them as part of a sale of the business. These Terms, the Privacy Policy, the Refund Policy, and the Earnings Disclaimer are the entire agreement between you and us about the Site and the Product.
